Full-Cycle Legal Protection for Single Individuals | Peace & Independence: Care for Person, Stewardship for Assets, Trust for Affairs
Disclaimer
This document is an introduction to legal service products and does not constitute legal advice for individual cases. The specific service plan shall be subject to the formal retainer contract.
Against the backdrop of increasingly diverse lifestyles and family structures, single individuals have growing long-term and comprehensive legal needs covering medical care, voluntary guardianship, asset management, elderly care arrangements and posthumous affairs.
For single persons, advance planning is not limited to estate disposal upon death. It also covers who will manage personal and property affairs if they suffer sudden illness, accidents, incapacity or cognitive decline, how to ensure their will is respected, and how to supervise the performance of relevant duties.
To meet the above demands, the legal team led by Lawyer Li Jingjing from Jiangsu Deshan (Xinyi) Law Firm launches the Peace & Independence Plan, a full-cycle legal protection package for single individuals. Through risk assessment, customized planning, legal document drafting, institutional coordination, implementation verification and ongoing maintenance, we help clients build a complete legal protection system covering planning while competent, response upon incapacity, and execution after death.
I. Service Positioning: From Single Document Preparation to Full-Cycle Legal Arrangement
Systems including voluntary guardianship, insurance, trusts, wills and estate administration correspond to legal needs at different stages and of different natures.
- Insurance provides risk protection and funding for claims settlement;
- Trusts undertake asset trusteeship and conditional payment;
- Voluntary guardianship pre-designates guardians and care arrangements;
- Wills and estate administration govern posthumous asset distribution and handover of affairs.
If these documents are prepared separately without overall coordination, practical problems may arise: unclear scope of authorization, blocked fund payment channels, disconnection between guardianship duties and supervision mechanisms, and inconsistency between lifetime arrangements and posthumous execution.
The Peace & Independence Full-Cycle Legal Protection Plan is not merely a drafting service for individual legal instruments, nor does it focus on purchasing specific insurance or trust products. Based on the client’s actual demands and enforcement conditions, we conduct integrated review and cohesive design of all legal tools.
II. Product Logic: Coordinated Use of Multiple Legal Tools with Clear Practical Boundaries
We adopt a service model of unified demand assessment + customized solutions + annual review + special enforcement: we first assess personal needs and tailor plans according to the client’s city and asset status; we update arrangements via annual reviews; special enforcement services will be activated separately upon incapacity or estate succession.
Four interconnected modules work in tandem:
- Emergency Affairs Arrange emergency contacts and medical assistance for sudden incidents; draft emergency power of attorney and advance medical directives. ⚠️ Reminder: Issuing authorization documents does not guarantee automatic acceptance by hospitals, banks and other institutions.
- Voluntary Guardianship Arrange personal care and asset protection after loss of capacity; draft guardianship agreements, alternate guardians and supervision rules. ⚠️ Under the Civil Code, a written voluntary guardianship agreement takes effect without notarization; notarization is only recommended for smoother implementation, not a statutory requirement for validity.
- Coordination Between Insurance and Trusts Sort out funding sources and design rules for trusteeship and conditional disbursement. ⚠️ Insurance and trust products are subject to institutional approval. We do not guarantee investment returns or absolute asset isolation.
- Wills and Posthumous Affairs Plan estate distribution and the duties of the estate administrator; coordinate funeral arrangements, pet care, digital assets and other non-property matters. ⚠️ Guardianship terminates upon the client’s death and cannot be directly equated with estate administration authority.
Practical Key Notes
① Notarization of voluntary guardianship is recommended in line with local notary practice to improve enforceability; ② Activation of guardianship usually requires medical certificates, judicial appraisal or even court proceedings. Advance medical authorization cannot replace full medical informed consent; ③ If the settlor is the sole beneficiary of a trust, the trust will generally terminate upon the settlor’s death, with trust property falling into the estate. Trust and will arrangements must be reviewed jointly.
III. Tiered Plans Tailored to Individual Circumstances
(1) Urban Comprehensive Protection Plan
Suitable for clients living in cities with abundant professional service providers, especially those owning real estate, substantial financial assets or insurance policies, with demands for long-term care funding, professional supervision and multi-institutional coordination. Core content: voluntary guardianship, notarization coordination, insurance-trust linkage, medical and elderly care contingency plans, professional supervision and estate administration.
(2) Regional Lightweight Protection Plan
Suitable for clients in prefecture-level cities and counties, and those who prefer concise legal arrangements. This plan is designed for clients whose assets mainly consist of residential property, bank deposits, pensions and a small number of insurance policies, or where local professional trust and guardianship services are limited. We prioritize emergency contact arrangements, voluntary guardianship, basic wills, asset inventories, supervision and alternate appointment clauses. Trust structures will only be further evaluated if necessary, including the feasibility of cross-regional trusteeship and ongoing service support.
(3) Cross-Border Coordinated Protection Plan
Suitable for Chinese citizens residing overseas, foreign nationals with domestic assets or requiring domestic care, residents of Hong Kong, Macao and Taiwan, as well as clients whose guardians, beneficiaries or assets are distributed across multiple jurisdictions. We comprehensively review nationality, habitual residence, tax residency, asset location and beneficiary domicile. Where necessary, we coordinate domestic and overseas professionals to resolve issues including will consistency, cross-border payment, document legalization and applicable law. Overseas legal and tax opinions shall be provided by qualified practitioners in the relevant jurisdictions.
IV. Service Procedure: From Demand Assessment to Ongoing Maintenance
The service follows this standard workflow:
- Initial Interview & Conflict Check Verify the client’s identity, service needs and cross-border factors; conduct conflict-of-interest checks and confirm civil capacity.
- Risk Diagnosis & Plan Confirmation Issue a risk assessment report, analyze the necessity, scope and enforcement costs of each legal tool, and finalize the service package.
- Appointment of Persons & Institutional Communication Help select guardians, supervisors, alternate appointees and emergency contacts; conduct preliminary communication with notaries, insurers and trust institutions as required.
- Document Drafting & Cross-Check Integrate and review voluntary guardianship, insurance, trust, will and estate administration documents to avoid conflicting authority, omissions or execution gaps.
- Execution of Formalities: Signing, Notarization & Institutional Filing Assist with document execution, notarization, beneficiary changes, trust establishment and registration formalities as needed.
- Implementation Check & Desktop Simulation Verify document storage, contact sequence, fund flow and emergency activation procedures, and keep written inspection records.
- Annual Maintenance & Special Service Activation Update legal arrangements on an annual basis. Upon incapacity or death, we launch corresponding special services in accordance with law, contractual terms and special power of attorney.
V. Deliverables: A Complete, Continuously Updatable Enforcement File
Subject to the selected plan and individual circumstances, the client will receive the following deliverables:
- One general report covering personal legal risks, tool selection, enforcement roadmap and outstanding issues;
- Four sets of core legal documents concerning emergency affairs, voluntary guardianship, insurance-trust coordination, wills and posthumous arrangements;
- A full set of institutional paperwork for notarization, insurance, trust and other administrative procedures;
- One enforcement manual compiling document indexes, contact information, activation conditions, payment arrangements, annual review reports and revision records.
The actual scope of documents and deliverables shall be governed by the selected service package and the signed retainer contract. The trust establishment and document review service will not be included if the trust module is not selected.
VI. Safeguarding Personal Will and Life Order with Professional Planning
